I. Introduction

  1. Application of this Privacy Policy

    Toyoko Inn Co., Ltd. and its affiliated companies (hereinafter collectively referred to as “Company,” “we,” “our” or “us”) strongly recognize the importance of personal information of our customers, and with a view towards privacy protection, we will comply with laws and regulations concerning personal information protection and strive to handle and manage such information appropriately as set forth in this Privacy Policy (hereinafter referred to as this “Policy”).

    The affiliated companies referred to herein include the Japanese branch of Toyoko Inn International Limited and other affiliated companies that are Toyoko Inn's franchisees in Japan. Toyoko Inn Co., Ltd. shall be ultimately responsible for managing personal information at these affiliated companies.

    The persons to whom this Policy applies include users of our apps and web services, and customers who use Toyoko Inn in Japan operated by us, and also include other people who conduct any transaction with us or contact us by telephone or other means (hereinafter collectively referred to as “Customer(s),” “you,” or “your”).

  2. Handling of personal information in providing accommodation services and related services

    The services provided by Company are mainly accommodation and related services. Therefore, personal information necessary to conclude a lodging contract with Company or to make a lodging reservation is mainly acquired.

    We will collect and store personal information to the extent necessary to provide these services to you, and if necessary, will provide such data to subcontractors who perform part of our business in providing these services. For details, please refer to Section II Our Handling of Personal Information.

  3. Handling of personal information regarding use of our website (advertising and access analysis)

    In connection with the use of Company’s website (hereinafter referred to as the “Website”), we will acquire, store, and, if necessary, provide the access status and activity history of Customers on the Website to the Company’s contractors for the purpose of targeted advertising or marketing, etc. to Customers from the perspective of improving customer convenience and services provided.

    If you do not want us to provide such information to our contractors, you may choose to opt out of sending your information to contractors or other third parties on the privacy settings pop-up, or on the pop-up that appears when you click on “Privacy Settings” in the footer of the Website. Please refer to Section III for details.

  4. Handling of personal information regarding Sleep PJ

    “Sleep PJ” is a service that analyzes the sleeping conditions of guests in some hotels and guest rooms during their stay and provides them with numerical data on their sleep quality. The data that we acquire through Sleep PJ includes the guest’s breathing rate, heart rate, body movements, and pressure on the bed while sleeping, etc. The data is obtained from sleep sensors attached to the mattress.

    Such data will be used to provide sleep data to guests and to improve our hotel fixtures, facilities, and guest rooms, and will not be used for any other purpose. The acquired data will be sent to a subcontractor for analysis and quantification in a form that does not identify individuals.

    If you do not wish to use Sleep PJ when staying in a Sleep PJ-enabled room, you may stop us from obtaining your sleep data by unplugging the sleep sensor. For more information, please refer to Section IV.

Chapter 2 Our Handling of Personal Information

  1. Scope

    This section applies to your contact with us through our booking site toyoko-inn.com and our mobile apps, your face-to-face contact with us when you visit Toyoko Inn, or when you communicate with us by telephone, text message, direct message, social media, or other similar means.

    This Policy also applies to your personal information that we receive from third parties and applies to all the Customers who use the services we provide.

  2. Purpose of use of personal information

    We will use your personal information for the following purposes and will not use it for any other purposes, unless otherwise stipulated by law or we indicate the purpose of use separately.

    In addition, we will use and store your personal information for the period necessary to carry out the purpose of use in accordance with legal and regulatory obligations, etc. After the required retention period, we will dispose of your personal information in accordance with our policies and procedures.

    1. To accept and manage reservations (including confirmation, change, cancellation, reminder, and other communications) for the hotels operated by us (hereinafter referred to as the “Hotel”);
    2. To authenticate individuals and provide various services for registered users on the Website;
    3. To provide services at the Hotel (lodging, food and beverage, parking lot use, sales of goods, and sales and provision of other incidental products and services);
    4. To manage the information of Toyoko Inn Club Card Membership members and to provide services to them;
    5. To provide data to the Customers who use the sleep data provision service and to improve hotel fixtures, facilities, guest rooms, etc. based on such data;
    6. To manage the information of Toyoko Inn Club Corporate Business Membership members and to provide services to them;
    7. To pay for, settle, bill, refund, receive cancellation fees, issue receipts, and perform other tasks related to settlement for our services;
    8. To respond to comments, requests, and inquiries from Customers;
    9. To conduct surveys on accommodations in the form of questionnaires regarding the Hotel for the purpose of improving and enhancing our services and facilities;
    10. To distribute e-mail magazines issued by us and to contact you about various campaigns and notices, etc.;
    11. To accept applications for various campaigns conducted by us, contact winners, and send gifts;
    12. To accept pre-opening monitor accommodations at the Hotel;
    13. To prevent unauthorized contracts, unauthorized use of services provided by us, and nonpayment of fees, as well as investigation and handling of such cases when they occur;
    14. To investigate and respond to failures, malfunctions, or accidents of our systems, networks, etc.;
    15. To fulfill contractual obligations to Customers, persons involved in the process of making travel arrangements for Customers (travel agents, group travel organizers, Customer's employers, etc.), and outside vendors (credit card companies, airline companies, bus companies, etc.);
    16. To conduct market research, customer satisfaction surveys and quality assurance surveys;
    17. To conduct marketing and sales promotions and provide targeted advertising about products, services, events or promotions that we believe may be of interest to you;
    18. To ensure the safety and security of staff, Customers, visitors, and others;
    19. To prevent, detect and investigate fraud, cyber incidents or other illegal or harmful activities;
    20. To communicate with you regarding our relationship with you, such as revisions to this Policy or other material legal or business changes;
    21. To meet legal or regulatory requirements or to fulfill compliance obligations;
    22. To test and evaluate new products and services;
    23. To carry out any other purpose which we disclose to you under applicable law or with your consent; and
    24. To use certain personal information to verify your identity in accordance with this Policy when you make a request with respect to your personal information.

    In addition to the above, the Hotel is equipped with surveillance cameras in the reception, lobby, and other areas shared by the Hotel’s guests, which may be used for the following purposes.

    • To help protect the health and safety of the Hotel’s guests and staff
    • To help us manage and protect the property of the Hotel and the property of the Hotel’s staff, guests and other visitors.
    • To improve the Hotel’s service level

    We may also work with other companies to provide advertising or marketing that we believe is relevant and useful to you. This advertising or marketing may include advertisements that appear on the Website or our apps or in e-mails or other communications from us, or our advertisements that appear on other companies’ websites.

    The advertisements you see are based on information we or third parties collect and your use of the Website or our apps or third party websites.

  3. Purpose of Use, Handling and Legal Basis of Personal Information

    We obtain the following personal information from Customers to the extent necessary for the purposes of use described in the preceding paragraph.

    1. Basic customer information (address, name, gender, date of birth, nationality, passport number, e-mail address, telephone number, facsimile number, postal address, etc.);
    2. Additional information about the Customer (e.g., occupation, work information (company name, address, telephone number, department, title), Customer’s vehicle number, etc.);
    3. Passport, visa, and other government-issued identification information in conjunction with (1) and (2) above;
    4. Payment information (credit card number, bank account information, billing address, receipt address, etc.);
    5. Information on the use of our services (lodging history, facility usage, usage history of various plans, product purchases, etc.);
    6. Contents of communications sent by you to us (e.g., telephone voice recordings, e-mails, website form entries, facsimile transmissions, telephone notes, letters, and survey responses);
    7. Information collected through the use of security systems installed by Company and the Hotel (e.g., surveillance cameras);
    8. Information automatically collected on the Website (cookies, IP address, browser type, access date and time, etc.);
    9. Information in the accommodation list (address, name, occupation, nationality, passport number, age, first night, second night, date of arrival, date of departure, room number, etc.);
    10. Information on the Toyoko Inn Club Card Membership application form (name, gender, telephone number, address, nationality, postal code, copy of passport (only for non-Japanese nationals), etc.). You may be asked to present an official identification card to verify your identity.)
    11. Data on your breathing rate, heart rate, body movements, pressure on the bed, etc. during sleep obtained at Hotels that provide sleep data services; and
    12. Data concerning your sleep state obtained through the analysis described in the preceding item.
  4. Personal Information Management System

    We will establish a management system for personal information that is appropriate to our business operations, strive to maintain accurate and up-to-date personal information of Customers to the extent necessary to achieve the purposes of use as described in 2. Purpose of use of personal information above. We will also take necessary and appropriate organizational, physical, and technical measures to prevent leakage, loss, or damage of such personal information and to otherwise manage the security of personal information.

    In addition, we will strive to raise employee awareness by providing thorough in-house personal information protection training to ensure that all employees engaged in the handling of personal information handle Customers’ personal information in an appropriate manner.

  5. Providing Personal Information to Third Parties

    We will not disclose or provide personal information to third parties without your consent, except as required by law.

  6. Outsourcing

    While providing products and services to you, we may outsource a part of our business to a contractor and provide your personal information to the contractor within the scope necessary to achieve the purpose of use.

    In such cases, we will appropriately manage and supervise the contractors, including entering into a contract with them regarding the handling of Customers’ personal information, to make them fulfill the same obligations as set forth in this Policy.

  7. Joint use
    1. Joint use within the domestic group and with overseas establishments
      We share the personal information of Customers with our group companies in Japan and our affiliates in South Korea, the Philippines, and Mongolia (hereinafter referred to as "Overseas Establishments") to provide and conduct common services for Customers.

      Joint users: Toyoko Inn Group companies (click here for details), Toyoko Inn Korea Co., Ltd., Philippine Toyoko Inn, Inc. and Mongolia Toyoko Inn LLC.
      Purpose of joint use:For the purposes stated in 2. Purposes of use of personal information above.
    2. Joint use with overseas establishments
      In addition, we offer a service called Toyoko Inn Club Card Membership, which provides the same benefits and services at our overseas establishments and at Toyoko Inn’s operations in Japan.
      Member information of Toyoko Inn Club Card Membership is obtained at the Hotels in Japan and overseas establishments when you become a member, and is stored in Japan, but is also shared by the Hotels of overseas establishments to provide common services and improve convenience.

  8. Transferring personal information outside of Japan

    Based on the preceding paragraph, we transfer Customers’ personal information to our overseas establishments. When transferring personal information, we conclude a contract with each overseas establishment regarding the protection of personal information to ensure that the personal information of Customers is properly managed and used at the recipients.

  9. Anonymized information

    We will create anonymized personal information and provide it to third parties to the extent permitted by law, after taking appropriate protective measures to ensure that specific individuals cannot be identified and that the personal information used to create the information cannot be restored.

    1. Compliance with relevant laws, regulations, guidelines, etc.
      We will handle anonymized information appropriately in compliance with APPI and other laws and regulations, as well as the Guidelines Concerning the APPI and other guidelines.
    2. How anonymized information is created
      We process Customer information and create anonymized information in accordance with the processing standards set forth in the APPI.

      5.Other measures based on the nature of the personal information database, etc.

      c. Information on your sleep condition obtained from the analysis in (b) above.

      The items included in the anonymized information and the method of provision of such information when we provide anonymized information to a third party are as follows.

    When we receive a request from a Customer for disclosure, correction, addition, deletion, or suspension of use of personal information held by us in accordance with the APPI, we will respond without delay after confirming that the request is made by the Customer himself/herself, except in cases where we are not obligated to accept the request under the APPI or other laws and regulations.

    “Sleep PJ” is a service that allows guests at select Toyoko Inn hotels in Japan to analyze their sleep patterns and learn about their sleep patterns. For more information about Sleep PJ, please click here.

    Additionally, the sleep PJ Terms of Use will be applied automatically when the service is used.

  2. Information to be obtained by Sleep PJ

    In addition to information related to your lodging reservation, we will obtain data related to your breathing rate, heart rate, body movements, and pressure on the bed while you sleep.

  3. Purpose of obtaining information in Sleep PJ

    The two main purposes are:

    1. To analyze each data acquired from sleep sensors and provide numerical values to Customers who use Sleep PJ; and
    2. To improve Toyoko Inn's hotel fixtures, facilities, guest rooms, etc. based on the data obtained.
  4. How information in Sleep PJ is obtained

    The acquisition method is to acquire the data described in 2. above from the sleep sensor attached to the mattress in the guest room while you are sleeping.

    The acquired data, which cannot be used to identify individuals, will be sent to KDDI Corporation for analysis and quantification. KDDI Corporation will provide us with the results of the analysis and quantification.

  5. Use of Information by Company

    We obtain the processing results provided by KDDI Corporation as your personal information and provide them to you through the Toyoko Inn App.

  6. If you do not wish to use Sleep PJ

    You might be given a Sleep PJ-enabled room even though you do not wish to receive this service.

    If you do not wish to receive this service, you may stop us from collecting your data while you sleep by unplugging the in-room sleep sensor. For more information, please contact Hotel employee.

Chapter 1   General

Article 1 : (Application)
These Terms of Use of Sleep PJ (hereinafter referred to as "Terms") set forth the terms and conditions (including, but not limited to, the terms and conditions of use, etc.) relating to the use of the "Sleep PJ" services (hereinafter referred to as "Services") operated and provided by Toyoko Inn Co., Ltd. (hereinafter referred to as "Toyoko Inn") and apply to all customers who use the Services.
Article 2 : (Objectives and Purposes)
The Services allow a customer staying at a hotel of Toyoko Inn to obtain the results of the analysis and visualization of the sleep state of the customer on the day of his/her stay through Toyoko Inn’s application, and Toyoko Inn provides the Services in accordance with these Terms. The Services may be provided only at certain hotels of Toyoko Inn.
Article 3 : (Terms)
  1. Toyoko Inn will provide the Services in compliance with applicable laws and regulations.
  2. In using the Services, in addition to these Terms, various terms and conditions, terms, precautions for use, guidelines, etc. specified by Toyoko Inn (including any notices given to users by Toyoko Inn from time to time; hereinafter collectively referred to as the “Various Terms" and, together with these Terms, collectively referred to as “Terms, etc.”) shall apply together with these Terms.
  3. Toyoko Inn may amend these Terms, etc. in accordance with laws and regulations without the customer’s consent. In such a case, the content and terms of provision of the Services shall be in accordance with the amended Terms, etc.
  4. Customers will be notified of amendments to these Terms and other important matters, etc. concerning the Services by way of postings made on Toyoko Inn's official website or the dedicated application provided by Toyoko Inn.
    However, any amendment to these Terms shall become effective upon the arrival of the relevant effective date after the content of the amended Terms and the effective date of such amendments are made known in advance on the relevant website or application.
Article 4 : (Application for Use)
  1. The Services are for Toyoko Inn Club card members only. Some services are also available to customers who have an official Toyoko Inn account.
  2. A customer who wishes to use the Services must agree to these Terms in advance and may not use the Services without agreeing to these Terms. The customer must agree to these Terms at the time of booking or checking into a certain hotel where the Services are available.
    An application for the use of the Services shall be completed when the customer has agreed to these Terms and has completed checking into a hotel that provides the Services.
  3. If Toyoko Inn determines that a customer who has applied to use the Services falls under any of the following items, Toyoko Inn may refuse to provide the Services to such customer without assuming any responsibility.
    1. If the customer has committed any act in the past that violates or is likely to violate these Terms, etc.;
    2. If the customer has violated, is in violation of, or is likely to violate any of terms of use in using any service provided by Toyoko Inn other than the Services;
    3. If the customer is an Antisocial Force (meaning, collectively, an organized crime group (meaning an organized crime group as prescribed in Article 2, Item 2 of the Act on Prevention of Unjust Acts by Organized Crime Group Members (Act No. 77 of 1991)), an organized crime group member (meaning an organized crime group member as prescribed in Article 2, Item 6 of said Act), a company related to an organized crime group, a corporate racketeer, a rogue person or group proclaiming to be a social activist, a rogue person or group proclaiming to be a political activist, an organized special intellectual crime group, and any other person equivalent thereto as well as a person who has a close relationship with such persons.);
    4. If the provision of the Services by Toyoko Inn to such customer interferes with the performance of Toyoko Inn's business; or
    5. In any other cases Toyoko Inn deems inappropriate.

Chapter 2   Description of the Services

Article 5 : (Service Configuration)
The Services shall consist of the services set forth in the following Items:
  1. Monitoring of the customer's own sleep state
    The customer can learn about his/her own sleep state from the results of the analysis of data measured by "Sleep Monitor 02", which is a sleep measurement device installed in the bedding of the guest room (hereinafter referred to as "Sleep Monitor").
  2. Various content services aimed at improving sleep and health
    Based on the sleep state of the customer described in the preceding item, Toyoko Inn will provide various content aimed at improving sleep and health.
  3. Any other services specified by Toyoko Inn
Article 6 : (Required Content)
The customer is required to download the "Hotel Toyoko Inn Official App" (hereinafter referred to as the "Toyoko Inn App") in order to receive the services described in the preceding article.

Chapter 3   Data Handling

Article 7 : (Measuring and Generating Data)
  1. The Sleep Monitor built into the bedding installed in the guest room and sold by KDDI CORPORATION (hereinafter referred to as "KDDI") measures data such as the heart rate and body pressure of the customer while he/she is sleeping.
    Measured data, Sleep Monitor identifiers (hereinafter referred to as "Device ID"), authentication identifiers and log information (hereinafter collectively referred to as "Measured Data, etc.") are sent to facilities in Japan managed by KDDI.
    The Measured Data, etc. sent to KDDI will not include information that can identify an individual.
  2. KDDI creates data showing sleep state based on the Measured Data, etc. (hereinafter collectively referred to as "Sleep Data"), analyzes sleep state using the Sleep Data, and sends to Toyoko Inn the analysis results, which are linked to the Device ID and authentication identifier of the Sleep Monitor.
  3. In the Services, Toyoko Inn links the results in the preceding paragraph sent from KDDI to the customer's identification information and displays such results on its "Toyoko Inn App", and only Toyoko Inn retains information that identifies the customer, Measured Data, etc. and Sleep Data. KDDI will not retain any information that can identify the customer.
Article 8 : (Data Use and Protection)
  1. Toyoko Inn and KDDI will handle any information related to the customer obtained in providing the Services in an appropriate manner in accordance with the following terms and policies:

  2. Toyoko Inn may use the information on the customer, Measured Data, etc., Sleep Data obtained through the provision of the Services and the results of the analysis and processing thereof, after anonymizing the same so as not to identify the customer, for the purposes specified in each of the following items and to the extent necessary for the execution of Toyoko Inn’s business:
    1. Effectiveness evaluation, function improvement and quality improvement of the various functions of the Services and the services provided mainly by Toyoko Inn;
    2. Measurement and analysis of the usage of the Services and the services provided mainly by Toyoko Inn;
    3. Investigation and response to failures and defects in the Services and the services provided mainly by Toyoko Inn; and
    4. Statistical analysis for the purpose of developing new functions or marketing activities for the Services and the services provided mainly by Toyoko Inn, or development, research, and service improvement of new services.
  3. Toyoko Inn may disclose to its contractors information on the customer, Measured Data, etc., Sleep Data obtained through the provision of the Services and the results of the analysis and processing thereof, and anonymized information thereof to the extent necessary for the purposes set forth in the preceding paragraph.

Chapter 4   General Terms

Article 9 : (Outsourcing)
Toyoko Inn may outsource part of the Services to a third party.
Article 10 : (Discontinuation, Suspension, etc. of Provision of the Services)
  1. Toyoko Inn does not undertake to provide the Services on a permanent basis and may change all or part of the content of the Services or discontinue providing the Services without giving prior notice of or disseminating the same to the customers.
  2. Toyoko Inn may suspend or temporarily cease the provision of all or part of the Services without the consent of the customer in any of the following cases:
    1. If there is any malfunction of devices such as the Sleep Monitor;
    2. If there is any failure in the system of the Services of Toyoko Inn and KDDI;
    3. If the provision of the Services becomes impossible or difficult due to force majeure such as a fire, power outage, natural disaster or other causes not attributable to Toyoko Inn;
    4. If Toyoko Inn determines that the provision of the Services will interfere with the execution of Toyoko Inn’s business; or
    5. In any other cases where Toyoko Inn determines that it is necessary to suspend or temporarily cease the provision of the Services based on reasonable grounds.
  3. Toyoko Inn will not be liable to customers or any third party for any change in the content of the Services or the discontinuation, suspension, or cessation of the Services under the preceding two paragraphs.
Article 11 : (Termination of Use of the Services)
  1. If the customer cancels his/her Toyoko Inn Club Card membership, he/she will not be able to use the Services.
  2. If Toyoko Inn determines that the customer falls under any of the following items, Toyoko Inn may terminate the use of the Services by such customer and revoke such customer’s eligibility to use the Services without requiring any procedures such as notice or demand:
    1. If the content of the application for use and other customer information provided to Toyoko Inn are found to be false, incomplete, or likely to be false or incomplete;
    2. If the customer violates or is likely to violate the provisions of these Terms, etc., and fails to correct such violation despite being requested to do so by Toyoko Inn;
    3. If the customer is found to be an Antisocial Force;
    4. In any other cases where he/she is deemed to be inappropriate as a customer by Toyoko Inn.
Article 12 : (Prohibited Acts)
The customer shall not engage in any acts set forth in the following items:
  1. Any act that causes a third party other than the customer to use or attempt to use the Services;
  2. Any act of using the Services for profit;
  3. Any act that requires the provision of services beyond the content described in these Terms, etc., or any act similar thereto;
  4. Any act that defames Toyoko Inn or any person using the Services;
  5. Any act that damages or is likely to damage the reputation, character, etc. of Toyoko Inn or any person using the Services;
  6. Any act that infringes or may infringe on copyrights, intellectual property rights or other rights held by Toyoko Inn or any person who uses the Services;
  7. Any act that causes or is likely to cause Toyoko Inn or any person who uses the Services to suffer a disadvantage or damage;
  8. Any act that interferes with or disrupts the use or enjoyment of the Services by any other customer of the Services or the provision of the Services by Toyoko Inn;
  9. Any act that is contrary to public order and morals, including crime and anti-social acts or any act related thereto;
  10. Any act that violates or is likely to violate laws and regulations; or
  11. Any other acts Toyoko Inn deems inappropriate.
Article 13 : (Compensation for Damage)
Even if the customer suffers any damage due to the use of the Services or inability to use the Services, Toyoko Inn will not compensate for such damage. However, if the damage is due to Toyoko Inn's willful misconduct or gross negligence, Toyoko Inn will compensate the customer for such damage up to the amount of fees incurred by the customer to receive the Services.
Article 14 : (Matters to Note)
  1. The Services do not constitute medical treatment or the practice of medicine
  2. Since the Sleep Monitor is not a medical device, it cannot be used for diagnosis, treatment, cure or prevention.
  3. Toyoko Inn and KDDI do not warrant the safety, accuracy, reliability, or usefulness of the Services, or the suitability, etc. of the Services for any particular purpose intended by the customer.
  4. Toyoko Inn and KDDI will not be liable in any way except as set forth in the proviso to the preceding article.
  5. Except as set forth in the preceding article, Toyoko Inn will not be responsible for any objections, complaints and claims, etc. beyond the scope set forth in these Terms, etc.
Article 15 : (Severability)
Even if any provision of these Terms, etc. or any part thereof is determined to be invalid or unenforceable based on laws and regulations, the remaining provisions of these Terms, etc. shall continue to be valid.
Article 16 : (No Assignment)
The customer shall not assign all or any part of his/her rights and obligations under these Terms, etc. to a third party or provide them as security for himself/herself or a third party.
Article 17 : (Court of Competent Jurisdiction)
In the event that litigation becomes necessary regarding this Service, the Tokyo District Court shall be the court of first instance with exclusive jurisdiction.
